Trademarks
In modern economies new brands for goods or services often become very important and emblematic flags of companies and businesses. We help and assist clients in any trademark protection related issue in a range of Portuguese language jurisdictions, including Portugal and the European Union, Macao, Angola, Mozambique, S. Tomé e Príncipe and Cape Verde.
Conducting availability searches and advising on whether a trade mark can be registered is key to implementing a trademark strategy and a part of our daily practice. We file and prosecute trademark applications and handle maintenance acts. Unlike copyright and patent rights, trademarks rights have no limitation in time provided that the registration is renewed. However in many jurisdictions use of the mark is required and it may be necessary to file declarations of use.
We can also provide watch services and assist clients in trademark enforcement, litigation matters and licensing projects.
We represent clients before the national Industrial Property Offices and other bodies such as the Office for Harmonization in the Internal Market (OHIM) regarding Community Trademarks and WIPO in respect of the International Registration system.
