A design may be defined as the appearance of the whole or a part of a product. In our time designs are absolutely crucial for the success of products. Great designs are a combination of aesthetic and practical concerns and attract the attention of users and potential customers.
Almost any industrial or handicraft item can be eligible for design protection: packaging of products, a product or a set of products, a composite product, a part of a product, logos, computer icons, typefaces, drawings and artwork, get-ups, ornamentation, web design or maps.
Typically designs may be protected before commercialization through registration at national level or at the European Union level (Registered Community Design). Alternatively, an unregistered Community design will also benefit from legal protection. We assist designers and businesses in design protection issues, namely by conducting searches, advising on protection strategies, filing and prosecuting design applications. Our legal team also assists clients in design enforcement, invalidation and litigation matters and provide infringement opinions.
We represent clients before the national Industrial Property Offices and the Office for Harmonization in the Internal Market (OHIM) regarding the Registered Community Designs.
